Terms of Service

1. Acceptance of Terms

By accessing or using the Goranos platform (the "Platform"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all users of the Platform, including internal users (employees and staff of the contracting company) and external users (customers accessing the customer portal).

2. Description of the Service

Goranos is a multi-industry business management platform that provides customer relationship management (CRM), communications, project management, lending, property management, and related business tools. The Platform is provided as a software-as-a-service (SaaS) solution to businesses (the "Contracting Company") who manage their operations through it.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify the Contracting Company immediately of any unauthorized use of your account.
  • The Contracting Company may create, modify, or deactivate user accounts at its discretion.

4. Customer Portal Access

Customers of the Contracting Company may be granted access to a customer portal for viewing project information, payment status, documents, and communication history. Portal access is provided through magic link authentication (email-based verification) and is subject to the following conditions:

  • Portal access is granted and managed by the Contracting Company.
  • You may only access information that pertains to your own accounts, contracts, and transactions.
  • Portal access may be revoked by the Contracting Company at any time.
  • Information displayed in the portal is provided for informational purposes. Official records are maintained by the Contracting Company.

5. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or systems.
  • Interfere with or disrupt the Platform's infrastructure or other users' access.
  • Use automated tools (bots, scrapers) to access the Platform without prior written authorization.
  • Upload or transmit malicious code, viruses, or any harmful content.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Platform to send unsolicited communications (spam) through any channel.

6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how personal data is collected, used, and shared. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.

The Contracting Company is the Data Controller for any personal data processed through the Platform. Goranos acts as the Data Processor, handling data on behalf of the Contracting Company in accordance with Colombian Law 1581 of 2012 and applicable data protection regulations.

7. Intellectual Property

The Platform, including its software, design, logos, and documentation, is the intellectual property of Goranos and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Platform without prior written consent.

Data entered into the Platform by the Contracting Company and its users remains the property of the Contracting Company. Goranos does not claim ownership of your data.

8. Third-Party Integrations

The Platform integrates with third-party services including but not limited to: Meta (Facebook/Instagram), Google Ads, WhatsApp Business, email providers, and payment systems. These integrations are subject to the terms and conditions of each respective third-party service. The Contracting Company is responsible for ensuring compliance with the terms of any third-party services it activates through the Platform.

9. Service Availability

Goranos strives to maintain high availability of the Platform but does not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance in advance.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Goranos shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. This includes, but is not limited to, loss of profits, data, business opportunities, or goodwill.

11. Modifications to Terms

Goranos reserves the right to modify these Terms at any time. Changes will be published on this page with an updated date. Continued use of the Platform after changes are published constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify affected users.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any disputes arising from these Terms shall be resolved in the competent courts of Colombia.
